Death of the lessor

The death of the lessor does not terminate a lease. The building passes to the lessor’s heirs. They thus become the owners of the building and cannot challenge the validity of the lease. In other words, the lease continues until the end of its term and may be renewed. Both the heirs, as the new lessors, and the lessees must respect the rights and obligations resulting from the lease.

Payment of rent

In the event of the lessor’s death, the lessee who is unsure of the identity of the person to whom he or she must pay the rent may apply to the Tribunal administratif du logement to be allowed to deposit his or her rent there, until such identification is made.

The application must be made against the succession of the lessor (defendant) and served at the lessor’s last domicile.
