MONTREAL, April 29, 2021 – The Tribunal administratif du logement is advising citizens that early this morning it suspended access to its online service used to access Tribunal records in light of the facts reported by Le Devoir.
The Tribunal is concerned about the situation and working to find a solution that will ensure a better balance between access to judicial information and the protection of this data from potentially fraudulent use.
The personal information obtained by the Tribunal in the exercise of its adjudicative functions is not confidential under section 53 of the Act respecting Access to documents held by public bodies and the Protection of personal information. This exception is the corollary of open court proceedings. The Tribunal is nevertheless conscious of the importance of preventing the use of this information for illegitimate purposes.
The suspension will be maintained until the Tribunal identifies a satisfactory solution to this end.
